In 1990, Congress increased the statutory penalties of the Occupational Safety and Health Act (OSHA) seven-fold. That action, coupled with a stepped-up enforcement level by the Department of Labor, transformed OSHA representation from a relatively minor part of the practice to one that occurs on a frequent basis. On OSHA matters, our involvement with clients covers the full range of counseling, from guidance in establishment of safety programs and preparation and maintenance of appropriate documentation to avoid OSHA violations, to representation of clients at informal settlement conferences after an OSHA citation has been issued, and through completion of trial of contested cases.
